Breach of Contract Claim Against Dracut Police Supervisors Dismissed

In this Superior Court action, a retired Dracut police officer sued the Dracut Chief of Police and Deputy Chief of Police. 

The retired officer, who was the subject of an internal affairs investigation and negotiated disciplinary settlement while he was an active officer, claimed that the Chief and the Deputy breached the officer’s settlement agreement with the Town and defamed him when information relating to the investigation and discipline was provided to the Massachusetts Peace Officer Standards and Training Commission and to the Middlesex County District Attorney’s Office.

Attorney Andy Gambaccini represented the Chief and the Deputy Chief in the litigation.  In compliance with a court rule to confer prior to engaging in motion practice, a substantive writing was sent to the plaintiff’s side, explaining why, as a matter of law, the plaintiff’s claims could not withstand the forthcoming dispositive motion. 

Following the writing, the plaintiff elected simply to dismiss all of his claims, with prejudice and for no consideration.
